Notice and Demand for Immediate Cease and Desist of Name

Karli — Sat, 03/16/2013 - 00:47

Mr. Brad Craft

Podunck-ville, Texas

Re: Cease and Desist Demand

March 15th, 2013

Dear Mr. Craft,

This office represents the alumni of “Golden Panda Showers Raid" (hereby referred to as "Original GPS"), who are the original members of the raid group in Downfall Guild, Alliance faction of the Gorgonnash Server in World of Warcraft. It has come to my attention that you have been, and are, engaged in the use of another raid group, also entitled "Golden Panda Showers," which you purport to run on behalf of Downfall Guild or on behalf of subsect within Downfall Guild.

This letter demands that you cease and desist from any use of the name "Golden Panda Showers”, or its well-known nickname, “GPS”, in connection with any raid formation or enaction, for casual or serious raiding purposes, or other assemblage of any nature, whether by printed or electronic means. Golden Panda Showers, or GPS, has well established common-law rights in both names, dating back many years and long before you recently purported to appropriate the Golden Panda Showers raid that recently appeared on the Downfall Guild website. This letter further demands that you cease and desist from any other activities or communications of any nature, by which you hold yourself out as an authorized representative of Golden Panda Showers or any part or faction thereof, or as leader or
facilitator of the raid group “GPS”.

Please confirm, in writing, by not later than March 20th, 2013, that you have discontinued the conduct
described in this letter. In the event that the conduct continues or is repeated from or after that date, my office has been instructed to commence the appropriate litigation against you without further notice.

I look forward to hearing from you.

Very truly yours,

Karin Hinze, PHR

The only thing better than Karli's well thought out spoken letter with perfect legal grammar was this inevitable response from Grasen.

Let this comment serve as evidence as to why Texas needs to appropriate more money towards their public school system.

Ghostess — Thu, 03/14/2013 - 07:47

Due to alreading raiding two nights a week and all the other things going in game I am pretty much at my limit for game time vs real life. And the war department is starting to grumble a bit which almost never happens O_O

Good luck all!
